REAL ESTATE DEVELOPMENT, ACQUISITION AND SALE

The firm's attorneys serve as lead counsel and negotiators for owners, developers and retailers in connection with the acquisition, development and sale of major real estate projects. The scope, diversity and size of these projects give the firm a unique ability to provide superior service in this area.

We have extensive experience developing shopping centers and freestanding retail sites. We have developed such regional shopping centers as:

  • Monticello Marketplace (a multi-owner facility anchored by Target, Ukrop’s and T.J. Maxx) in Williamsburg, Virginia
  • Broad Creek Crossing (a 56-acre site developed under three separate ground leases and anchored by Home Depot, Target and Food Lion) in Norfolk, Virginia
  • Libbie Place (Target, Barnes & Noble and PetsMart) in Richmond, Virginia
  • North Pointe Shopping Center (Home Depot, Kroger, Bed, Bath & Beyond and PetsMart) in Durham, North Carolina

We have also been extensively involved in the revitalization of JANAF Shopping Center, a centrally located strip “power center” in Norfolk, negotiating leases for over 400,000 square feet of anchor tenant space and numerous additional leases with national and regional tenants. We are very familiar with issues relating to multi-owner integrated real estate developments and issues related to cross-easement and similar agreements. We have represented both developers and retailers in negotiating and structuring their real estate projects, including Norfolk-based developer, S.L. Nusbaum Realty Co., and Colonial Foods (a Pizza Hut franchisee with over 100 locations).

In addition to retail development, our Real Estate Group is involved in a number of other areas, including acquisition and development of office buildings and office parks and the acquisition of sites for manufacturing, office and warehouse facilities by companies relocating to the Hampton Roads region. We are regional counsel to Liberty Property Trust (a publicly-traded REIT specializing in Class A suburban office and industrial/warehouse product) and represent corporate/commercial enterprises in their real estate matters including:

  • Major regional health care provider
  • Fortune 500 transportation company
  • National media company
  • Publicly-traded supermarket chain

We have also assisted in several large acquisitions for manufacturers over the years that involved:

  • Mercedes-Benz
  • Volvo Cars of North America
  • Volvo Penta
  • Kettler International
  • Stihl Incorporated
  • Kransco Corporation

Our service as counsel to Volvo Cars included the development and sale of over 500 acres of prime commercial real estate in the Greenbrier section of Chesapeake, Virginia. We assisted Volvo in drafting and negotiating the contract for the construction of public streets and utilities and advised Volvo on various development issues, including wetlands and other environmental laws and subdivision, zoning and other local development approvals.
