Kevin serves as national coordinating counsel, medical/science counsel, and trial counsel for several defendants in asbestos and cosmetic talc litigation. He has a particular expertise in the development and deployment of the medical and scientific defense of alleged asbestos-related claims.

Kevin's practice also includes the defense of a variety of products liability, premises and other general liability cases, as well as commercial landlord-tenant disputes and related litigation.

Experience

  • Advises several companies in the identification, recruitment and development of experts, including in the areas of genetics, carcinogenesis, epidemiology, occupational medicine, pathology, industrial hygiene, toxicology, and the state of the art.
  • Member of national trial teams for several defendants in asbestos litigation, including Honeywell International Inc.
    • Served as co-lead/first chair trial counsel in over 40 individual cases during the last 10 years.
    • Regularly assigned as trial counsel for cases with challenging or unusual allegations and medical issues (i.e., spontaneous mesothelioma; localized mesothelioma; well-differentiated papillary mesothelial tumors; peritoneal mesothelioma cases, especially among female and young plaintiffs; radiation-induced mesothelioma; cases involving genetic testing or motions to obtain genetic testing).
    • Prepares other trial team lawyers for cross examination and direct examination of expert witnesses, including briefing trial lawyers on cross and direct examination strategy, as well as preparing defense expert Frequently attend trials – even when not assigned as trial counsel – to prepare expert witnesses for examination.
  • National coordinating counsel for national retailer sued in cosmetic talc litigation.
  • Presented arguments and examined plaintiff and defense expert witnesses in evidentiary hearings in support of Daubert motions.
  • Reviewed, analyzed and presented on current and emerging medical and scientific literature relevant to the defense of asbestos-related litigation to fully prepare defense experts and fellow trial team members, as well as cross examine plaintiff experts at trial and deposition.
  • Tried approximately 20 cases to verdict as first chair counsel, and prepared and argued product and premises liability cases in state and federal courts, including before the Virginia Supreme Court.
  • Represented product manufacturers, contractors and premises owners in defense of various product liability actions related to cotton seed, propane tanks, commercial overhead doors, logging equipment, commercial and residential boilers, and other products.
  • Represented large outdoor theme park, brewery and resort.
  • Represents several commercial landlords in a variety of landlord-tenant disputes, including cases involving reclaiming possession of the premises, collecting delinquent rent, enforcing personal guarantees, and negotiating lease termination agreements.
  • Represents insureds in personal injury lawsuits involving premises liability and automobile and trucking accidents.
  • Represented railroads in general litigation and FELA matters.
  • Won dismissal of lead-based paint personal injury action against a residential landlord, and successfully defended against Plaintiff’s appeal to the Virginia Supreme Court. See Steward v. Holland Family Props., LLC, 284 Va. 282, 726 S.E.2d 251 (2012).
